5.                  AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY AND THE ESCONDIDO FIREFIGHTERS' ASSOCIATION,  NON-SAFETY BARGAINING UNIT, AND SEVERANCE AGREEMENT FOR THE EMERGENCY MEDICAL TECHNICIANS (EMT) Request Council approve an amendment to the Memorandum of Understanding between the City and the Escondido Firefighters' Association, Non-Safety Bargaining Unit, extending the term until June 30, 2010, and associated severance agreement for the Emergency Medical Technician classification

6.                  SEVERANCE AGREEMENT FOR ESCONDIDO CITY EMPLOYEES' ASSOCIATION (ECEA) Request Council approve a severance agreement for affected employees laid off within the Escondido City Employees' Association

            RESOLUTION NO. 2009-102

7.                  ADOPTION OF AN INTERIM URGENCY ORDINANCE PLACING A MORATORIUM ON THE LEGAL ESTABLISHMENT AND OPERATION OF MEDICAL MARIJUANA DISPENSARIES Request Council (1) Adopt an interim urgency ordinance placing a moratorium on the legal establishment and operation of medical marijuana dispensaries; and (2) Direct staff to study the applicable legal and land use issues and develop appropriate zoning and licensing guidelines or regulations governing such uses, and/or a possible prohibition on such uses if that is authorized by law and desired by the Council

8.                  AWARD PURCHASE OF FUELS FOR BUDGET YEAR 2009-2010 Request Council authorize the purchase of fuels (gasoline and diesel) from SOCO Group, Incorporated, utilizing a City of San Diego Purchasing Agreement which contains a Public Agency Clause with renewable extensions

9.                  BID AWARD FOR CONSTRUCTION OF PHASE IV OF THE POLICE AND FIRE FACILITY, BID PACKAGE 02B (LANDSCAPING) Request Council authorize the Mayor and City Clerk execute an agreement with Green Horizons Landscape and Maintenance, in the amount of $265,000, for Bid Package 02B (Landscaping) of the Police and Fire Facility located at 1163 North Centre City Parkway

            RESOLUTION NO. 2009-66

10.              REQUEST TO INITIATE A ZONE CODE AMENDMENT TO EXPAND THE PERMITTED NUMBER OF DOGS IN RESIDENTIAL ZONES Request Council initiate a Zone Code Amendment to expand the number of permitted dogs for single family dwellings in the R1, RE, and RA Zones. Specific numbers of dogs and minimum administrative standards would be developed through the process

13.              THE "BEFORE THE THREAT" 2009 PREPAREDNESS CAMPAIGN - COUNTYWIDE Fire Department staff to present information to the Council concerning this year's countywide "Before the Threat" wildfire education campaign

14.              ZONE CODE AMENDMENT TO ARTICLES 16 AND 64 AND AMENDMENT OF THE INTERIM DOWNTOWN SPECIFIC PLAN (CASE NO. AZ 09-0001/PHG 09-0011) A request  for amendments to Article 16-Commercial Zones and Article 64-Design Review of the City's Zoning Code, and amendment of the Interim Downtown Specific Plan (SPA 9) to establish development standards regarding the conversion of automobile dealerships to other uses. The amendment would require a plot plan application for the conversion (either in whole or in part) of new and used automobile dealership sites to other uses in order to confirm compliance with the development standards. The development standards would require addressing the site in a comprehensive way regarding such issues as multiple tenants, tenant space entries, display areas, signs, parking and screening, landscaping, street trees, and lighting
